Agreement to Terms

By accessing our website, booking our photography services, or engaging with Zluzarinzelal in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Zluzarinzelal, governed by New Zealand law. If you do not agree with any of these terms, you must immediately cease using our website and services.

These terms apply to all users of our website, including visitors, clients, and anyone who accesses or uses our services. We reserve the right to modify these terms at any time, and your continued use of our services after such modifications constitutes acceptance of the updated terms.

Services

Zluzarinzelal operates as a professional photography studio in Auckland, New Zealand, specialising in editorial-style and lifestyle photography. Our services encompass a comprehensive range of photography offerings designed to capture authentic moments and create timeless imagery. Our service portfolio includes:

• Portrait photography sessions (individual, couples, and group portraits)
• Family and lifestyle photography (in-home and outdoor sessions)
• Personal branding and professional headshot photography
• Editorial and creative photography shoots
• Studio-based natural light photography sessions
• Newborn and maternity photography
• Event and milestone celebration photography

All services are provided in accordance with New Zealand professional standards and business practices. Service availability may vary based on location, season, and photographer availability.

Service Standards and Quality

We are committed to delivering high-quality photography services that meet professional standards. Our services will be:

• Performed with reasonable care and skill
• Fit for the purpose for which they are supplied
• Delivered within a reasonable timeframe
• Provided in accordance with any descriptions or samples provided

If our services do not meet these standards, you may be entitled to remedies under New Zealand's Consumer Guarantees Act 1993.

Booking and Payment

Session Booking

All sessions require a booking confirmation and may require a deposit to secure your date. Deposits are typically non-refundable but may be transferred to a future session date subject to availability.

Payment Terms

• Session fees are provided in our quote and are valid for 30 days
• Full payment is due on or before the session date unless otherwise agreed
• Payment can be made via bank transfer or other agreed methods
• Images will be delivered only after full payment is received

Cancellation and Rescheduling

Client Cancellation

• Cancellations made more than 7 days before the session: deposit may be transferred to a new date
• Cancellations made less than 7 days before the session: deposit is forfeited
• No-shows forfeit both deposit and session fee

Rescheduling

We understand that life happens. Sessions may be rescheduled once without penalty if notice is given at least 48 hours in advance. Subsequent rescheduling may incur an administrative fee.

Studio Cancellation

In the rare event that we need to cancel or reschedule your session due to illness, emergency, or unforeseen circumstances, we will offer a full refund or the option to reschedule at no additional cost.

Weather Policy

For outdoor sessions, we monitor weather conditions closely. If conditions are unsuitable, we will work with you to either:

• Reschedule to an alternative date
• Relocate to an indoor or covered location
• Proceed if you're comfortable with the conditions

Copyright and Usage Rights

Photographer's Rights

All photographs created during your session are the intellectual property and copyright of Zluzarinzelal. We retain the right to use images for:

• Portfolio and website display
• Social media marketing
• Print and digital promotional materials
• Photography competitions and exhibitions

Client's Rights

Upon full payment, you receive a personal use license allowing you to:

• Print images for personal use
• Share images on personal social media
• Use images for personal announcements

Commercial use of images requires a separate licensing agreement.

Image Alterations

You may not alter, edit, or apply filters to images in a way that misrepresents our work. Minor adjustments for social media (cropping, brightness) are acceptable.

Image Delivery

• Edited images are typically delivered within 2-4 weeks of your session
• Images are provided via an online gallery for download
• Raw, unedited files are not provided
• We recommend backing up your images, as galleries have limited availability

Liability

While we take every precaution to protect your images, Zluzarinzelal shall not be liable for:

• Loss of images due to equipment failure, theft, or other unforeseen circumstances
• Injuries occurring during outdoor sessions
• Damage to personal property during sessions

In the event of total image loss, our liability is limited to a refund of session fees paid.

Model Release

By booking a session, you grant Zluzarinzelal permission to use your photographs as outlined in these terms. For sessions involving minors, a parent or legal guardian must provide consent.

Advertising and Marketing

Zluzarinzelal may use various advertising platforms, including Google Ads, to promote our photography services. Our advertising practices comply with:

• Google Ads policies and guidelines
• New Zealand's Fair Trading Act 1986
• Advertising Standards Authority (ASA) codes
• Consumer protection legislation

All advertisements accurately represent our services, pricing, and availability. We do not engage in misleading or deceptive advertising practices. Any promotional offers or discounts will be clearly stated with terms and conditions.

Website Usage and Intellectual Property

The content on our website, including text, graphics, logos, images, and software, is the property of Zluzarinzelal or its content suppliers and is protected by New Zealand and international copyright laws. You may not:

• Reproduce, distribute, or transmit any content without written permission
• Use our website content for commercial purposes
• Modify or create derivative works from our content
• Remove copyright or proprietary notices

You may view and download content for personal, non-commercial use only, provided you maintain all copyright and other proprietary notices.

Limitation of Liability

To the maximum extent permitted by New Zealand law, Zluzarinzelal's liability for any claim arising from our services is limited to:

• The amount paid by you for the specific service giving rise to the claim
• Re-performance of the service where applicable

We are not liable for any indirect, consequential, or special damages, including but not limited to loss of profits, loss of data, or emotional distress, except where such liability cannot be excluded under New Zealand law.

Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law principles. Any disputes, claims, or legal proceedings arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of New Zealand, specifically the courts of Auckland.
